General Rental Conditions

Effective Date: July 8, 2025

1. Purpose These general rental conditions apply without restriction or reservation to all online rentals offered by the company Rossignol on the website Rossignol.fr (hereinafter: "the Site").

The Site is an e-commerce platform dedicated to the rental of non-perishable consumer goods (hereinafter: "the Products") by private individuals (hereinafter: "Users") (hereinafter: "the Services").

The objective is to offer Users a new consumption model for the Products, by promoting their rental rather than outright purchase.

The purpose of these general conditions is to define the terms and conditions for the online rental and delivery of Products, as well as to define the rights and obligations of the parties within this framework.

They are accessible and printable at all times via a direct link at the bottom of the Site's page.

The applicable version of the general conditions is the one available online on the Site on the date of the User's order, a copy of which is sent to them with their order confirmation.

These general rental conditions are supplemented, for the parts they do not cover, by the general sales conditions of the rossignol.com website.

2. Seller Identity and Contact The Site is operated by the company SKIS ROSSIGNOL, a simplified joint-stock company registered with the Grenoble Trade and Companies Register under the number 056 502 958, with its registered office located at 98, rue Louis Barran, 38430 St Jean de Moirans (hereinafter: "Rossignol"), which offers the Products for rent.

3. Legal Capacity and Acceptance of General Conditions

3.1. Legal Capacity The Site is accessible:

  • To any natural person with full legal capacity to enter into these general conditions. A natural person who does not have full legal capacity may only access the Site with the consent of their legal representative.
  • To any legal entity acting through a natural person with the legal capacity to contract on behalf of the legal entity.

3.2. Acceptance of General Conditions The User's acceptance of these general conditions is materialized by a checkbox in the order form. This acceptance can only be full and complete. Any conditional acceptance is considered null and void. A User who does not agree to be bound by these general conditions should not place an order on the Site.

4. Product Characteristics Before any online order and in application of the provisions of article L111-1 of the French Consumer Code, the User can view the characteristics of each Product they wish to order on the Site.

The Products are offered for online rental subject to availability, or subject to the possibility of ordering them if applicable.

The User is informed and accepts that the ordered Product is rented in its current condition and may have been subject to prior rental(s) before being reconditioned by Rossignol.

The photographs and descriptions of the Products offered for online rental are as accurate as possible. They only bind Rossignol for what is precisely indicated.

However, the User is informed and accepts that the rented Product delivered to the User may not correspond to the exact model of the Product photographed and presented on the Site at the time of their order.

5. Ordering

5.1. Placing an Order Any User can place an Order for one or more Products without prior registration on the Site.

To place an order, the User must select the Product of their choice, place it in their cart, and select the chosen rental duration. They can access the summary of their cart at any time until the order is finally validated and can correct any errors in the entered information.

The order is considered received by Rossignol when Rossignol can access it.

As part of their order, the User is invited to provide their contact details for delivery and invoicing purposes. They must fill in all fields marked as mandatory in the form provided for this purpose. Orders that do not contain all the required information cannot be validated.

The User guarantees that all information they provide in the order form is accurate, up-to-date, and truthful and is not misleading.

They are informed and accept that this information serves as proof of their identity and is binding upon validation.

5.2. Security Deposit The Order can only be validated after the User has provided a bank guarantee equivalent to the price of the new Product. This deposit is managed by a deposit management partner of Rossignol. A card registration will therefore be requested via SMS or email from the User before the payment for the Order is confirmed. Bank details are managed by Rossignol's banking partner in compliance with data protection regulations and are kept for the duration of the rental plus twenty days. The return of the Products and the verification of their condition in compliance with their arrival at Rossignol automatically trigger the deletion of the security deposit's bank data. In the event of non-return of the Products on time or non-compliant return, the penalties indicated in article 7.4 of these GTC will be applied.

If the User cancels their Order before the Products are shipped, the corresponding security deposit will be automatically cancelled.

5.3. Order Confirmation After placing their order, the User receives an email confirmation that: (i) summarizes the elements of the order and the estimated delivery time, (ii) includes the general conditions in force on the day of the order, (iii) includes the invoice corresponding to the order.

The User must ensure that the contact details provided during their order are correct and allow them to receive the order confirmation email. If they do not receive it, the User must contact Rossignol at the details mentioned in article 2.

Rossignol recommends that the User keep the information contained in the order confirmation.

The order confirmation is considered received by the User when they can access it.

Rossignol reserves the right not to accept an order in case of non-compliance with these Conditions, in case of errors or anomalies in the order (e.g., quantities ordered unsuitable for private or family use), in case of an exorbitant discount or a ridiculously low price, in case of a payment incident or suspicion of fraud and/or abuse.

6. Price and Payment Terms

6.1. Price The rental prices for the Products are displayed on the Site.

They are indicated in euros, all taxes included (French VAT and other applicable taxes).

Rossignol reserves the right, at its sole discretion and according to terms it will be the sole judge of, to offer promotional offers or price reductions.

Prices do not include any delivery costs applicable to the delivery of the Products, which are billed in addition to their price. The amount of applicable delivery costs will be indicated before the User validates the order.

The applicable price is the one displayed on the Site at the time the User's order is placed.

6.2. Payment Terms The full rental price of the Product selected by the User is due upon ordering for any one-time rental.

The terms of a Product rental subscription and its financial conditions are detailed on the Site and will be accessible by Rossignol prior to any order.

In any event, the User is informed and agrees to pay a deposit to Rossignol in case of a rental subscription, the amount of which will be mentioned on the Site at the time of the Order.

Any delivery costs will be indicated on the Site.

Payment can be made online:

  • by credit card, through the secure online payment service indicated on the Site, ... or by any other means that will be offered on the Site at the time of the order.

The User guarantees to Rossignol that they have the necessary authorizations to use the chosen payment method.

Rossignol reserves the right to suspend or cancel any order and/or delivery in case of non-payment of any amount due by the User, in case of a payment incident, or in case of fraud or attempted fraud related to the use of the Site.

Penalties of an amount equal to 1.5 times the French legal interest rate will be automatically applicable to unpaid amounts from the first presentation of a formal notice by registered letter with acknowledgment of receipt.

6.3. Invoicing The purchase invoices will be sent to the User by email, with a link allowing them to consult these general rental conditions at any time.

7. Delivery

7.1. Delivery Territory Users are expressly informed that the Site only offers delivery of Products to the following countries:

  • Metropolitan France,
  • Italy

7.2. Delivery Methods The delivery of Products ordered on the Site is made to the address indicated during the User's order as the "delivery address" (which may be different from the billing address), which, unless there is a specific agreement between the parties according to the terms provided for in article 7.1, can only be located in one of the countries referred to in said article.

The User is informed before validating their order of the possible delivery methods for the ordered Product as well as the corresponding times and costs for each of these methods.

The User must select the desired delivery method and provide all the necessary information for the effective delivery of the Product according to that method.

7.3. Delivery Times The Site indicates, for each Product offered for rental, estimated delivery times depending on the regions, territories, and delivery methods selected by the User.

The actual delivery time will be confirmed to the User in the order confirmation email.

In the absence of delivery within the aforementioned period, the User may cancel the order, by registered letter with acknowledgment of receipt or by a writing on another durable medium, if, after having ordered Rossignol, by the same means, to make the delivery within a reasonable additional period, it has not performed within that period. The contract is considered terminated upon receipt by Rossignol of the letter or writing informing it of this termination, unless it has performed in the meantime.

In case of termination of the contract according to the above terms, the User will be reimbursed for all sums they have paid, including delivery costs, at the latest within 14 (fourteen) days following the date on which the contract was terminated.

In any event, Rossignol reserves the right to contact the User to offer alternative solutions for the reimbursement of the rental price of the Products and delivery costs. The User must explicitly express their acceptance of the choice of an alternative reimbursement method on a durable medium.

7.4. Product Return Conditions The User must return the rented Product to Rossignol within two business days of the end of the rental, as evidenced by the postmark.

In case of delay in returning the Products, the User will have to pay Rossignol 10 euros per day of delay.

This amount will be automatically deducted from their security deposit without being able to exceed the amount equivalent to the new price of the Product.

Beyond a maximum delay of fifteen days or when the equivalent of the new Product price has been reached in late fees, the Product will be considered not returned by the User, who will have to pay Rossignol the new price of the Product if this has not already been done. This payment will be made by debit via the bank imprint left by the User when paying their security deposit.

The Product must be returned to Rossignol in its original packaging in good condition.

Any return of a Product showing a defect beyond normal wear and tear, and/or requiring repair in order to be reused, will result in the payment of a penalty of a maximum amount of twenty euros (€20) per repair. If the condition of the Product does not allow for a new rental and the cost of repairs exceeds 50% of the new Product price, the User will have to pay a penalty equivalent to 50% of the new Product price.

8. Right of Withdrawal Users have a right of withdrawal, for a period of 14 (fourteen) calendar days from their reservation. They can exercise this right by sending a notification of their wish to withdraw via the following email address: contact@circular.rossignol.com before the expiration of the aforementioned period. The Customer Service will indicate the procedure to follow and will provide the User with a return number which will be confirmed by email. However, Users waive the possibility of exercising this right of withdrawal from the first day of the rental of the Products if the start of the rental period begins before the end of the aforementioned withdrawal period.

Examples:

  • Reservation on January 10 for a rental starting on February 10: the right of withdrawal can be exercised from January 11 to January 25 inclusive.
  • Reservation on January 10 for a rental starting on January 17: the right of withdrawal runs from January 11 to January 16 and expires on January 17, the first day of the rental.

Furthermore, a User who has exercised their right of withdrawal while the Product is already in the delivery circuit, at their express request, before the end of the withdrawal period, will owe an amount corresponding to the service provided until the communication of their decision to withdraw, this amount being proportionate to the total rental price agreed upon at the time of their order, in accordance with the provisions of article L 221-25 of the French Consumer Code.

The Products must be returned to Rossignol in their original packaging, without undue delay and at the latest within 14 (fourteen) calendar days following the communication, by the User, of their wish to withdraw. They must be accompanied by a copy of the corresponding rental invoice. The User is deemed responsible for any deterioration of the Products during their return to Rossignol.

The User will be reimbursed as soon as possible and at the latest within 14 (fourteen) days from the date of effective receipt by Rossignol of the withdrawal request for the full amount paid for their order, deducting any return costs, which remain the responsibility of the User. However, Rossignol reserves the right to defer this reimbursement until the effective recovery of the Products.

Rossignol reserves the right to refuse the return of a Product and not to proceed with its reimbursement:

  • in case of non-compliance with the withdrawal procedure mentioned above;
  • more generally if Customer Service is unable to identify the User or identify the order (order number, return number, contact details, etc.);
  • if the Product is not in its original packaging and condition (documents and accessories).

A discount on the reimbursement may be applied when the returned product has clearly been used beyond a simple test and appears damaged.

9. Legal Guarantees The User benefits from legal guarantees of conformity as well as for hidden defects of the rented item, including conformity defects resulting from the packaging of the Products ordered on the Site.

If the User finds that the Product delivered to them has a defect, a lack of conformity, or is damaged, they must inform Rossignol at the contact details mentioned in article 2 herein, indicating the nature of the defect, non-conformity, or damage found and sending any useful supporting documents, particularly in the form of photograph(s).

Rossignol will arrange the return procedures with the carrier of its choice, of which it will inform the User by any useful means. Rossignol will bear the costs of this return.

The Products must be returned to Rossignol in their original packaging. They must be accompanied by a copy of the corresponding purchase invoice.

Returns of Products that do not comply with the terms described above cannot be taken into account.

Rossignol will carry out the necessary verifications and will propose to replace the Product as far as possible. If the replacement of the Product is impossible, Rossignol will reimburse the User for the full price paid for the rental of the Product as well as the corresponding delivery costs, by any useful means, as soon as possible and at the latest within 14 (fourteen) days following the date on which Rossignol informed them of the impossibility of replacing the Product.

It is recalled that, when acting under the legal guarantee of conformity, any consumer:

  • can choose between the repair or replacement of the good, subject to the cost conditions provided for in article L217-9 of the French Consumer Code; - is exempted from providing proof of the existence of the conformity defect of the good for twenty-four months following its delivery.

It is also recalled that the legal guarantee of conformity applies independently of any commercial guarantee that may be granted.

Any consumer can also decide to implement the guarantee against hidden defects of the item sold within the meaning of article 1641 of the French Civil Code. In this case, they can choose between the cancellation of the rental or a reduction in the rental price in accordance with article 1644 of the French Civil Code.

10. User Obligations Users are solely responsible for the use they make of the Products. It is their responsibility to check the suitability of the Products for their specific needs prior to renting said Products.

They are also informed and accept that the rented Product is not new and has been refurbished prior to its rental.

Users also agree:

  • to provide Rossignol with valid information regarding their first name, last name, postal address, and email address;
  • not to seek to acquire any ownership rights over the Product;
  • not to sub-rent the Product or assign their rights and obligations under these general conditions to a third party;
  • to use the Product peacefully in accordance with its purpose;
  • to return the Product within the period specified on the Site at the time of their order, under penalty of activation of the late fees mentioned in article 7.4;
  • to keep the Product in good condition;
  • to return the Product in the condition in which it was made available to them; - to use the Product for personal purposes only.

The transfer of risks occurs when Rossignol physically takes possession of the Product. The User has custody of the Product for the entire rental period and guarantees its integrity.

The User pays a security deposit to guarantee Rossignol against any damage to the Product under the conditions of article 5.2.

11. Rossignol's Liability 11.1. Rossignol undertakes to regularly carry out checks to verify the functioning and accessibility of the Site. As such, Rossignol reserves the right to temporarily interrupt access to the Site for maintenance reasons. Similarly, Rossignol cannot be held responsible for temporary difficulties or impossibilities of access to the Site which originate from circumstances beyond its control, force majeure, or which are due to disruptions of telecommunications networks.

11.2. Rossignol provides no guarantee to the User as to the suitability of the Products for their needs, expectations, or constraints.

11.3. Rossignol cannot be held responsible for the non-performance or delay in the performance of rental contracts due to circumstances beyond its control or a case of force majeure, it being expressly specified that are considered cases of force majeure, in addition to those usually retained by the jurisprudence of French courts: exceptional bad weather, natural disasters, fires and floods, lightning, attacks, cases of breakdown or blocking of telecommunications networks, means of transport or postal services, including due to strikes, damage caused by viruses for which the security means existing on the market do not allow their eradication, as well as any legal or regulatory obligation or public order imposed by the competent authorities and which would have the effect of substantially modifying these general conditions.

11.4. In any event, the liability that may be incurred by Rossignol hereunder is expressly limited to only proven direct damages suffered by the Users.

12. Intellectual Property All texts, comments, works, illustrations, videos, works, and images reproduced or represented on the Site are protected by copyright and belong to us or to third parties who have authorized us to use them. As such, and in accordance with the provisions of the Intellectual Property Code, only the viewing of the Site for private use is authorized.

Any total or partial reproduction or representation of our Site or of all or part of the elements found there is strictly prohibited.

The company names, trademarks, and distinctive signs reproduced on the Site are protected under intellectual property rights. The reproduction or representation of all or part of one of the aforementioned signs is strictly prohibited and must be subject to prior written authorization from the rights holder. Failure to comply with this prohibition constitutes an act of infringement that may be subject to legal proceedings.

13. Personal Data Rossignol has a personal data protection policy whose characteristics are explained in the document entitled "Personal Data Protection Charter," which the User is expressly invited to read:

14. Prohibited Behaviors 14.1. The following are strictly prohibited: (i) all behaviors likely to interrupt, suspend, slow down, or prevent the proper functioning of the Site, (ii) all intrusions or attempts to intrude into Rossignol's systems, (iii) all misappropriations of the Site's system resources, (iv) all actions likely to impose a disproportionate load on the latter's infrastructure, (v) all attacks on security and authentication measures, (vi) all acts likely to harm the financial, commercial, or moral rights and interests of Rossignol or the users of its Site, (vii) any practice diverting the Site for purposes other than those for which it was designed, and finally, more generally (viii) any breach of these general conditions or of the laws and regulations in force.

14.2. It is also strictly forbidden to monetize, sell, or grant all or part of the access to the Site, as well as the information it contains.

14.3. In the event of a breach of any of the provisions of this article or, more generally, of violations of laws and regulations, Rossignol reserves the right to take all appropriate measures and initiate any legal action.

15. Modifications Rossignol reserves the right to modify these general rental conditions at any time. In this case, the applicable conditions will be those in force on the date of the User's order.

16. Language In the event of a translation of these general conditions into one or more languages, the language of interpretation will be French in case of contradiction or dispute over the meaning of a term or a provision.

17. Mediation The User has the right to have free recourse to a consumer mediator for the amicable resolution of any dispute concerning the performance of these conditions that would oppose them to Rossignol, under the conditions provided for in articles L611-1 et seq. and R152-1 et seq. of the French Consumer Code.

18. Applicable Law and Jurisdiction These general conditions are governed by French law.

In case of dispute over the validity, interpretation, and/or execution of these general conditions, the parties agree that the courts of Paris will have exclusive jurisdiction to judge them, unless there are contrary mandatory procedural rules.
